Commercial - Assistant Manager (Legal) (Commercial)

Roles and Responsibilities

Land Procurement and Litigation Management:

  • Ensure the land procurement process for solar power plant projects is followed to the letter of the law including due diligence and documentation by working closely with the land procurement team & monitoring of all the activities being undertaken for procurement.
    • Manage disputes and litigations related to land procurement, boundary disputes, title defects, and other land-related issues internally, develop effective legal strategies and resolve land-related disputes with help of an external counsel in a timely and cost-effective manner.

Contract Management:

  • Draft, review, and negotiate contracts and agreements related to EPC projects, including contracts for equipment procurement, construction, and service agreements.
    • Ensure that contracts are aligned with the company's interests, comply with legal requirements, and mitigate potential risks.
    • Monitor contract performance and enforce contractual obligations to minimize disputes and delays.

Regulatory Affairs and Permitting:

  • Liaise with government authorities, regulatory agencies, and local communities to obtain necessary permits, licenses, and approvals.
    • Stay updated on changes in regulatory requirements and advise management on compliance obligations and potential impacts on project timelines and costs.
    • Assist in the preparation and submission of regulatory filings and reports as required by law.

Dispute Resolution and Litigation Support:

  • Represent the company in legal proceedings, arbitration, and mediation related to contractual disputes, project delays, and other legal matters.
    • Provide litigation support to external legal counsel, including document review, evidence gathering, and case analysis.
    • Develop strategies for alternative dispute resolution to resolve legal disputes efficiently and cost-effectively.

Legal Compliance and Risk Management:

  • Ensure legal compliance with applicable laws, regulations, and permits related to solar power plant operations, procurement processes, environmental regulations, and labor laws.
    • Assist in identifying legal risks associated with the company's operations and develop strategies for risk mitigation.
    • Conduct periodic audits and reviews to assess compliance levels and implement corrective measures as needed.

Legal Research and Advisory Services:

  • Conduct legal research on relevant legal issues, case law, and industry trends affecting the company's operations.
    • Provide timely and accurate legal advice and guidance to internal stakeholders on a wide range of legal matters, including contract interpretation, labor issues, and regulatory compliance.

Training and Knowledge Management:

  • Conduct training sessions and workshops for internal teams to enhance legal awareness and compliance within the organization.
    • Maintain a repository of legal documents, templates, and best practices to facilitate knowledge sharing and ensure consistency in legal processes and documentation
    • Act as a liaison between legal, operational, and external stakeholders to facilitate effective communication and resolution of legal issues.
